Party Wall Matters

The Party Wall etc. Act 1996 provides owners of buildings with certain rights and obligations to other owners in relation to party walls and other structures defined under the Act.

Building Owners are legally required to serve formal Notice prior to commencing works so as to afford the Adjoining Owner the opportunity to consider the proposals and to decide whether to obtain professional representation.

Philip Carey has acted for Building Owners and Adjoining Owners or as Agreed Surveyor, in various aspects of residential and commercial party wall matters, including:

  • Pre-commencement appraisals to advise on party wall matters in connection with building and development projects.
  • Preparation and service of Notices required for compliance with legal obligations.
  • Consultation with project designers in connection with proposals.
  • Preparation and negotiation of Party Wall Awards.
  • Preparation of Schedules of Condition.

Building Surveys

P L Carey & Co undertakes full building surveys (formerly known as ‘structural’ surveys) providing a detailed report for the purpose of advising on property condition, usually a requirement prior to purchase.  A sample report format can be provided, if required.

The building survey will not include for a valuation but can offer budget cost advice in respect of repairs. Typically, the building survey will include:

  • Building type, construction and general matters.
  • Inspection of external and internal building elements including testing for dampness.
  • Inspection of external grounds, boundaries and features.
  • Visual inspection of services installations such as drainage, electric, gas, heating and plumbing.
  • Identification of defects and recommendations in respect of remedial repairs.
  • Recommendations for specialist inspection and/or testing.

Contract Administration

Contract administration will include for advising on contractor selection, scheme tendering to contractors and administering the contract for full duration through to final certification.

Contract administration is often combined with scheme design, preparation of scheme drawings, dealing with statutory permissions, and preparation of a works specification, all services offered by P L Carey & Co.

Throughout his career, Philip has successfully undertaken the design and contract administration on many schemes both for residential and commercial clients.  He has also successfully undertaken employer’s agent role on various new build and refurbishment schemes.

  • Defect Diagnosis

    P L Carey & Co undertakes defect diagnosis and reporting in connection with matters arising on residential and commercial building types. Reporting will include for advice on remedial works and associated budget costs.

  • Structural Matters

    P L Carey & Co regularly works with an independent qualified structural engineer. Should structural engineering services be required, please indicate this on the enquiries form.

  • Maintenance and repair, general property
    advice and health & safety matters

    P L Carey & Co can provide specific advice, planned maintenance schedules, advice and services as Principal Designer (formerly CDM co-ordinator) under the Construction (Design & Management) Regulations 2015.
